Terms and conditions – #yessemper
Semper likes to see products in real life on social media and we may request to share pictures posted by you on Instagram in our channels. Such channels are mainly Semper’s websites but could also include Semper’s other channels, for example Semper’s newsletter, Semper’s social media channels etc. By responding #yessemper to a picture after Semper’s request on social media, you agree to the following:
License
You provide Semper AB a non-exclusive, perpetual, revokable, royalty-free, worldwide license to use, in any manner to be determined in our sole discretion and without any obligations to you. We may use your pictures in our marketing and/or advertising, including, for example, the right to reproduce, distribute, alter and edit your photos and captions. You also grant a right to us to sublicense the unrestricted right to exercise any of the foregoing rights to our partners. Furthermore, you give Semper your consent to use photos where you can be identified for marketing and/or advertising purposes.
Rights
You own or control the rights to the material you have submitted. This means that you guarantee that the material that you have submitted does not infringe the intellectual property rights or other rights of any third party, does not breach any obligations of confidentiality and does not violate any law. You also guarantee that any person(s) that can be identified in the pictures (either in the picture or by name) is aware of how the material will be used and has accepted that use. For a person under the age of 18, that person’s legal guardians have accepted the use. Moreover, you certify that you are a natural person and that you are at least 18 years old.
No compensation
You accept that you are not entitled to any compensation or reimbursement of any kind from Semper under any circumstances for the use of your pictures.
Indemnification
You agree to indemnify, defend, and hold Semper and all persons acting for Semper harmless from and against all claims (including claims from third parties), liabilities, damages and costs (including settlement costs and reasonable attorneys’ fees), irrespective of nature, arising in connection with your guarantees as described under ”Rights” above.
Privacy
Your privacy is important to us. And so is our interest in seeing our products in real life on social media. As you have posted the picture on Instagram, we deem it legitimate for us to use your picture in our channels as well, in line with these terms and conditions. However, you and everyone that can be identified in your picture always have the right to decide if you want to be a part of our content or not, and Semper will remove a picture at once when a person that can be identified in that picture so requests.
Semper AB and the relevant Semper entity in your country of residence acts as ”controllers" of the personal data that is processed under these terms and conditions.
